—The Standing Civilian Courts Order 1997 (Parts II and IV)

Well, we had our day in court. It was a bit stressful (in the these are scary people sort of sense), but I seemed to survive (and then went into town, lunched, and went to work).

The defence lawyer tried to assert that one or all of us had shouted racist abuse at the defendant (who needed to have an interpreter in the court), and also that the event was a result of us attempting to get around a parked car in the bus/cycle lane that we were in (rather than the coach coming into our space).

Diziet reports that a conviction ensued — Driving without Due Consideration – 3 points, £100 fine, £500 costs.

That kind of result does give hope to disillusioned cyclists like me that something might be done if I reported people behaving dangerously.

(I am quite suprised at part of the defence given though: is the lawyer really suggesting that it is OK to hit people who say racist things with large vehicles? Or was it a suggestion that people who shout racist abuse would also commit perjury?)

Or an effort to gain whatever compassionate discretion the sentence-decider might have?

Anyway, congratulations to Senji for getting this done!

It wasn't really me who was the driving force behind this. Blame Diziet, who is ept (and assertive).

I presume a general attempt to imply the witnesses were all evil racists who had it in for the poor innocent bus-driver and are lying about the event.

I imagine the lawyer put the allegations of racist abuse because (1) the defendant told him that's what happened and he desperately needed something to put in his closing speech (there being only so much you can say about a straightforward DDCA charge), and (2) if convicted, the lawyer could possibly comment upon it in mitigation.

I am assuming by the post title that you chose to affirm rather than take the oath?

All three of us in fact chose to affirm. Diziet and </a></b></a>mpinna on account of not being Christians, myself on account of Quaker influences.

Oh, excellent!

I'm slightly worried that it's legal to drive a coach in this country without that little English... What about road signs?

Most road signs are designed to be readable without understanding English (for obvious reasons), you can probably learn most of the rest from exposure.
